Seeing your business’s name on a lawsuit is something that no entrepreneur wants to go through, but it is much more common than you might think. If it ever happens to you, then it is important that you stay calm avoid panicking or doing anything drastic, and do the following instead:
1. Don’t Panic! Keep Calm and Carry On
First things first: Take a deep breath. Panicking is like a rocking chair; it gives you something to do but gets you nowhere. Remember, being sued doesn’t automatically mean you’re donning an orange jumpsuit. It’s a process, and like all processes, there are steps you can follow.
2. Don’t Go on the Defense Just Yet
While you might be tempted to fire off a heated email or rally a strongly-worded defense on social media, hold your horses. Any statements you make could be used against you in court. Think of it as a game of chess; silence is a strategic move.
3. Gather the Troops: Call Your Lawyer
Time to phone a friend—your lawyer, that is. If you don’t have one on speed dial, now’s the time to find a good one. Make sure they specialize in business litigation; you want a knight in shining armor, not a squire learning the ropes. They can provide criminal defense advice if needed, guide you through the legal jungle, and help you understand the charges at hand.
4. Review the Complaint with Your Legal Eagle
Sit down with your attorney and go through the lawsuit line by line. Understand exactly what you’re being accused of. It’s like reading the terms and conditions (for once), but this time, it really matters.
5. Preserve All Relevant Documents
Start gathering any and all documents related to the case. Emails, contracts, memos, text messages—you name it. It’s like preparing for the world’s least fun treasure hunt. This evidence can be crucial in defending your case, so the more organized you are, the better.
6. Consider Settlement Options
Not all lawsuits need to go to court. Sometimes settling is like hitting the emergency brake on a train headed for disaster. It can save you time, money, and a whole lot of stress. Discuss with your lawyer whether settling might be a better route than fighting it out in court.
7. Keep Your Team in the Loop
Keep key members of your team informed about what’s going on. You don’t need to spill all the beans, but ensuring that your management knows what’s up can prevent rumors and maintain morale. Plus, they might need to help with gathering documents or adjusting operations.
8. Stay Focused on Your Business
Just because you’re dealing with a lawsuit doesn’t mean your business needs to stop. Keep your eyes on the prize and continue to operate your business as best you can. It’s like patting your head and rubbing your stomach at the same time—tricky, but doable.
9. Learn from the Experience
Once the dust settles, take a step back and learn from the experience. Maybe you need to tighten up some business practices or improve how contracts are handled. Turn this legal lemon into lemonade and strengthen your business fortifications.
Getting sued isn’t a walk in the park, but with the right moves, it doesn’t have to be the worst thing that ever happens to you either!
